Terms & Conditions of Service

Effective Date: November 21, 2025

By booking a session or engaging in any service with Desi McCarthy Photographic Art ("The Photographer"), you ("The Client") agree to be bound by these Terms and Conditions.

1. Booking and Payments

  1. Deposit: A non-refundable Booking fee (specified during the initial consultation) is required to secure your session date and time.
  2. Booking of Payment: The Photographer accepts payment via EFT/Bank Transfer or other agreed-upon electronic methods.

2. Cancellations and Rescheduling

  1. Client Cancellation: If The Client cancels the session, the Booking fee is non-refundable.
  2. Rescheduling: Sessions may be rescheduled once, provided the Client gives a minimum of 7 days' notice. Rescheduling is subject to The Photographer's availability.
  3. Photographer Cancellation: In the unlikely event The Photographer must cancel, The Client will be offered an immediate reschedule or a full refund of all payments made.

3. Copyright and Usage

  1. Copyright: No images may be reproduced, sold, or published without the express written permission of The Photographer.
  2. Print Release: Upon final payment, The Client receives a limited print release allowing for personal printing and sharing of the purchased digital files. This does not transfer copyright.
  3. Model Release: The Client grants The Photographer the right to use the images for promotional, advertising, and marketing purposes, including portfolio, website, social media, and competition entries, Unless otherwise agreed upon, on Booking Form, by both The Photographer and The Client.

4. Final Images and Delivery

  1. Editing: All images delivered to The Client will be professionally edited and retouched according to The Photographer’s artistic style. Unedited, raw, or unretouched files will not be provided.
  2. Delivery Time: The final gallery delivery timeframe is approximately 2-3 weeks for standard sessions and 4-6 weeks for intimate weddings.
  3. Archival: The Photographer will archive the finished images for a period of 3 months following delivery. It is The Client’s responsibility to back up their files.

5. Client Responsibilities

  1. Appearance: The Client is responsible for their own grooming, wardrobe, and preparedness for the session.
  2. Cooperation: The Client agrees to cooperate and arrive on time. Any delay caused by The Client will result in a corresponding reduction in the shooting time.
  3. Safety: The Client is responsible for their own safety and the safety of any accompanying individuals or minors during the session.

6. Limitation of Liability

In the event of unforeseen circumstances (including but not limited to equipment failure, injury, or loss of memory cards), The Photographer's liability is limited to the refund of all moneys paid to date.

By proceeding with a booking, The Client acknowledges and accepts these Terms and Conditions.
